In regards to Mr. DiSalvo’s early Christmas present of a deferred prosecution, this has to amaze the average person who wouldn’t have had a chance in hell in court, given similar circumstances.

Or how about if the antics of the evening in question were reversed? Good luck hitting an off-duty cop who hasn’t raised his hands to you.

Anyone who was there (Jimmy’s) that evening knows exactly what transpired. Mr. DiSalvo, in a crass gesture reminiscent of “men’s club” activities, threw money on the floor surrounding a young lady who was looking for a dropped item. In a place not quite as trendy as Jimmy’s, the “stuff” could have really hit the fan, given the testosterone levels around here.

However, Mr. Drake, acting as any parent would, had every right to confront Mr. DiSalvo. In fact, any of his actions would have seemed quite acceptable. But Mr. DiSalvo, despite his high-priced (but-cheap-to-a-friend) lawyer’s comment of self-defense, thought a pre-emptive strike was in order.

Interesting precedent.

Over the months, I’ve already had a few chats on the subject with friends on the APD, and it’ll be interesting to hear their take on this recent outcome.

So friends, be sure and remember to ask for your “deferred prosecution” next time you’re in front of the judge. Seems only fair, right?
