Sundeck work will get the go-ahead

Permission to demolish the Sundeck will apparently be granted to the Aspen Skiing Co. from Pitkin County today, despite an Aspen Mountain landowner’s objections.

As long as the Skico meets conditions imposed by the county government, the project can proceed as scheduled, said Cindy Houben, director of community development for the county.

An administrative appeal of the county’s approval of the project was filed Monday by Wendy Urschel Long, who divides time between Aspen and Boca Raton, Fla. The appeal was filed on a variety of grounds.

Long said Tuesday she had hoped the county would “stay” the approval – prohibit any action – until her appeal was considered.

That is unlikely to happen. Houben said the county commissioners have 15 days from the receipt of the appeal to hold a hearing. She said she didn’t have grounds to withhold the permit.

Long is challenging the Skico’s permission to plow and use Little Annie Road for construction of the new Sundeck. Allowing the Skico to start using the road “means our appeal is basically worthless,” she said.

Seeking a restraining order through the courts to prevent the work isn’t an option at this point, said Long. First, the administrative appeal process must be exhausted. Plus, a sizable bond would have to be posted in case the appeal wasn’t found valid.

That bond could potentially be forfeited if the appeal hearings delayed completion of the new Sundeck until after Christmas and the Skico lost revenues.

Skico officials were essentially holding their breath and hoping to get the project under way today.
