Rizzuto trials set

Anthony Rizzuto, facing charges of burglary and armed robbery, agreed this week to waive his constitutional rights to a speedy trial in order to keep the trials in the two cases separate on the court calendar.

The burglary trial, in which police say Rizzuto was one of four local teens who broke into a Twining Flats house on Sept. 20, 1999, will begin Dec. 12 and run for four days.

The second trial, in which police allege that Rizzuto and Thomas Colver robbed the Aspen Alps condominium office on Aug. 6, 1999, will begin Jan. 16, 2001. That trial also is scheduled for four days, although defense attorney Joseph St. Veltri said he thought it might only take three days.

District Court Judge J.E. DeVilbiss asked Rizzuto if he would waive his right to a speedy trial because that deadline runs out in mid-December. Under the provisions of the U.S. Constitution, Rizzuto is guaranteed a trial within six months of filing a plea to the charges against him, which occurred in June.

During a hearing in 9th Judicial District Court Monday, it appeared for a while that the two cases against Rizzuto might have to be held one right after the other. Because of the court’s crowded schedule in the coming months, it appeared that the robbery trial would have to begin either on Dec. 6 or on Dec. 19.

But Rizzuto agreed to forgo his rights, and the dates were set.
