Musick seeks a takings hearing

W/J Ranch developer John Musick is seeking a “takings hearing” before Pitkin County in light of his failed efforts to win approval to develop the property with affordable housing.

Musick’s attorney has asked that the county revisit the affordable housing application for the property, regarding “a taking of private property without just compensation in violation of the United States and Colorado constitutions.”

County commissioners rejected Musick’s application to build 778 units of housing on the McLain Flats property last year and recently moved to downzone the property.

The hearing request was made to County Attorney John Ely, but it’s the county planning department that handles the scheduling for such matters.

According to Ely, requests for takings hearings are almost always granted. But planner Lance Clarke, who is in charge of scheduling the matter, could not be reached for comment Thursday.

I try to remember to give thanks every day I spend outside, whether it be floating the Colorado or Roaring Fork, fishing an epic dry fly hatch on the Fryingpan, or teasing up tiny brook trout on a remote lake or stream. We’re spoiled rotten here, so it’s easy to be thankful.
