Marijuana, booze found in crash driver’s car
Police officers found beer bottles, a flask and marijuana inside the car belonging to a 20-year-old college student who hit another vehicle head-on Sunday near Basalt, according to a police report.
Jack Galyon, the driver, admitted to drinking two beers and a shot and smoking marijuana several hours before the crash, according to a report from a Colorado State trooper. Galyon’s breath alcohol content after the crash was .095, above the legal driving limit of .08, the report states.
The driver of the 2011 Mini Cooper that Galyon hit, Shafigheh Lubin, 52, of Aspen, suffered a spinal injury, a collapsed lung, a broken leg and a broken ankle, according to the police report. She was still in the hospital Monday facing numerous surgeries, Aspen prosecutor Andrea Bryan said Monday.
Galyon, who grew up in the Highlands Ranch area, was released from jail Monday after posting a $7,000 bond. He is a sophomore at the University of Colorado, public defender Molly Owens said Monday.
Galyon told police he was heading to the Glenwood Springs area after attending the Winter X Games in Aspen, the report states.
“Mr. Galyon stated he was driving too fast, approximately 50 to 60 mph, when he lost control of his vehicle and went into the eastbound lanes,” according to the report.
Galyon told the officer he drank the two beers and a shot around 11:30 a.m. or noon after the officer smelled alcohol on him, the report states. The accident occurred about 5:50 p.m. Sunday near the Lazy Glen area.
The flask with an unknown alcoholic beverage inside was found on the driver’s side floorboard, while a “small pile of raw marijuana and a marijuana grinder” were found on the passenger side floorboard, the report states. Beer bottles in the vehicle’s backseat broke during the crash.
Galyon is charged with vehicular assault while under the influence, DUI, having an open container of alcohol in his car and having an open container of marijuana in his car.
