Main Street accident in Aspen detailed in lawsuit

A Snowmass Village woman claims in a lawsuit that she suffered serious injuries resulting from a traffic accident in downtown Aspen in November 2013.

Susan Saghatoleslami, 51, is the plaintiff in the suit filed earlier this week in Pitkin County District Court. She accuses another local resident, Matthew Donnelly, of running a red light in his 2012 Toyota pickup as he was headed east on Main Street, striking the driver’s side of her 2007 Lexus as she was driving south on Mill Street.

According to the suit, the accident occurred at 3 p.m. Nov. 23, 2013, which was a Saturday. Main and Mill streets is the busiest intersection in Aspen, city officials have said.



“Plaintiff had a reasonable expectation that she could proceed safely through the intersection of Main and Mill streets under a green signal and a further reasonable expectation that motorists on Main Street facing a red signal, including Donnelly, would obey the law and not drive through a red signal facing them,” the lawsuit, filed by Aspen attorney Jeff Wertz, states.

Donnelly is listed as the defendant along with his company, MMD Inc., of Snowmass Village. He could not be reached for comment on the suit.




Saghatoleslami suffered serious injuries, the complaint says, and had to undergo spinal injections. She faces possible hip-replacement surgery.

“Plaintiff’s injuries have caused her to miss work and have resulted in lost wages and income for the Plaintiff,” the lawsuit states. “Plaintiff’s injuries have impacted her ability to enjoy her life.”

The document names MMD Inc. as a plaintiff because Donnelly “was acting in the scope and course of his employment … at the time of the collision,” the suit says.

The lawsuit seeks a jury trial and the awarding of damages.
