Local man pleads to pot possession

A local man arrested for growing marijuana pleaded guilty to unlawful possession in 9th Judicial District Court.Kevin DeCarlo, 30, of Aspen, could face a one- to three-year prison sentence, as well as sizable fines, for the class 5 felony conviction. He is scheduled to be sentenced July 19.As part of the plea agreement, a count charging DeCarlo with possession of marijuana with intent to distribute and another “special offender” count, related to a safe in which DeCarlo had stored marijuana along with three firearms and cash, were dismissed, according to Lawson Wills, assistant district attorney.Federal sentencing guidelines stipulate that a conviction on the “special offender” charge, which targets armed drug dealers, carry an eight-year mandatory minimum prison sentence, Wills said.The firearms – a Colt AR-15 semi-automatic assault rifle, a Browning 9 mm handgun and a Smith & Wesson .22 caliber handgun – will be destroyed as part of the deal. So will the equipment used in the cultivation of the 51 marijuana plants seized from DeCarlo, Wills said.Some $300 in cash found in DeCarlo’s apartment at the time of his April 1 arrest will be donated to the Chemical Dependency Task Force, a local agency, according to Wills.The federal Drug Enforcement Agency’s investigation of DeCarlo was reportedly turned over to local authorities because the case was too small to prosecute in federal court. Aspen police confirmed that the DEA initiated the investigation of DeCarlo.
