Former Snowmass Inn owners sue

ASPEN – The family that owned the Snowmass Inn for 30 years is suing a host of limited liability companies after the lodge was sold at a foreclosure auction.

The Moebius Family Property LLC filed suit Tuesday in Pitkin County District Court in Aspen against CLWM LLC, Snowmass Mountain Chalet Owner LLC, Mountain Chalet and Snowmass Inn Joint Venture LLC, and The Related Companies LP.

The suit claims that in April 2007, the Moebius family transferred its ownership in the Snowmass Inn, worth $2 million, to the defendant LLCs, with plans to redevelop it. The Moebius family had a 28.57 percent ownership in the venture, the suit says.

The Snowmass Inn was sold in foreclosure in August to The Related Companies, “a fact that raises questions” because the LLCs in question were connected to Related, the suit says.

The suit is asking a judge to order an accounting of all the activities that preceded the foreclosure sale, and says Moebius has a “limited scope of understanding of what happened.”

“Currently, as a result of stonewalling by those with the answers, the Moebius family cannot help but think it is the victim of a misuse of the limited liability company form to perpetrate fraud and milk the entities of the joint venture of their assets, while simultaneously denying a minority member’s rightful claim to information,” says the suit, filed by the Denver law firm Polsinelli Shughart PC.
