Florida men face assault charges in fatal Steamboat bar fight

STEAMBOAT SPRINGS, Colo. ” Two brothers from Miami face assault charges after a fight in this ski town that authorities say led to the death of a Special Forces soldier.

Routt County District Attorney Elizabeth Oldham on Monday filed charges of second- and third-degree assault against 27-year-old Eduardo Capote Jr. and third-degree assault against 23-year-old David Capote.

Charles Feldmann, an attorney for the Capotes, said his clients were acting in self-defense and that Eduardo Capote Jr.’s wife filed an assault complaint against a companion of Lopez’s.

Second-degree assault carries a prison term of five to 16 years. Third-degree assault carries a sentence of up to two years in prison.

The judge set bail at $10,000 for Eduardo Capote Jr. and $1,500 for David Capote.

Authorities say the Capotes got into a fight with Sgt. 1st Class Richard Lopez of Fort Bragg, N.C., outside a bar in January.

An autopsy report said the 37-year-old Lopez was struck twice in the face before he fell, hitting the back of his head on the ground and suffering fatal head and brain trauma.

Authorities said Lopez and two friends got in an argument inside the bar with two other patrons after Lopez and his friends played a Jimmy Buffett song on the jukebox.

Lopez’s aunt, Gloria Bovadilla, said Lopez had served in Afghanistan, where he was shot and seriously wounded, and in Iraq.
