Court upholds Colorado smoking ban

DENVER ” A federal appeals court says Colorado’s smoking ban is constitutional.

In November, a coalition of bars, taverns and bowling alleys asked the 10th U.S. Circuit Court of Appeals to overturn the ban.

They argued it discriminated against them because the original law exempted casinos, cigar bars and smoking lounges at Denver International Airport.

The law has since been changed to include casinos under the ban

The state argued it had logical reasons for granting exemptions. The 10th Circuit agreed, saying lawmakers acted rationally.
