Carbondale trustees take another look at ‘fowl’ ordinance

CARBONDALE – The town trustees are taking a second shot Tuesday at a proposed ordinance that would put greater detail into the town code regarding the keeping of chickens, chicks and pullets and other fowl.
The matter was discussed at a meeting two weeks ago, according to Town Manager Jay Harrington.
“They took into account all the input from the public at that meeting,” Harrington said.
The chicken item is on the consent agenda, setting it up for passage without discussion, or it can be taken off the consent agenda to allow for more discussion.
The proposed ordinance would completely replace the existing regulations, which simply state that a resident can keep no more than six chickens, turkeys, ducks or geese. The only exception is for retail butchers or meat sellers.
Penalties are $100 for the first offense, $200 for the second, and $500 and/or six months in jail for subsequent offenses, according to Police Chief Gene Schilling, and would remain the same under the new ordinance.
Under the new code, if adopted, residents can keep “enough chicks and pullets to maintain six laying hens, with a total number of birds not to exceed 10 of any age at any time,” if they are for personal use only.
“No individual shall sell eggs,” the proposed code continues, “engage in chicken breeding or fertilizer production, slaughter chickens for commercial purposes, keep male chickens for any purpose within town limits, or raise chickens or other fowl for fighting purposes.”
The proposed law also lays out the minimum distance of any coop from a neighbor’s property and how coops should be built, and has provisions for communal chicken coops shared by more than one owner.
Tonight’s meeting agenda includes a continued hearing on the CMED medical marijuana center, and discussion of the Access Control Plan for Highway 133.
The meeting begins at 6 p.m. at Town Hall, 511 Colorado Ave.
