Building firm, bitter over Aspen brewers, files complaint

ASPEN ” A local construction firm has filed a complaint in Pitkin County District Court against the Aspen Brewing Co., and other parties, alleging it was not paid in full for work completed at the Mill Street brewery.

Bauhan Custom Builders Inc. of Basalt filed the complaint Nov. 21. The complaint, which was released Monday, seeks “monetary damages, costs, fees, interest, judicial foreclosure and sheri­ff’s sale and levy of the property” to be determined at trial.

Bauhan claims it performed construction improvements at the property.

The complaint states the brewery and Duncan Clauss, who also is listed as a defendant in the mat­ter, made partial payments to Bauhan but “failed and refused to pay in full for the work” under a contract. Several other parties are also listed as defendants in the complaint, including North Mill Street Investors, a general partnership that owns the 557 N. Mill Street property where the brewery is located.
