Basalt alters regulations on pot possession

BASALT – Basalt changed its regulations Tuesday on unlawful possession of marijuana and unlawful possession of drug paraphernalia to accommodate lawful use and possession of medical marijuana.

The changes create different standards on possession of pot and smoking devices for medical marijuana patients or caregivers who dispense medical marijuana. Certified patients and caregivers can possess up to 2 ounces of marijuana and they can carry paraphernalia.

Medical marijuana patients and caregivers must have a valid registry identification card issued by the Colorado Department of Health. A medical marijuana dispensary is operating at the WIN Institute, so the town needed to massage its regulations.



Non-medical marijuana patients and caregivers can still be cited under the town regulations for possession of up to 1 ounce of pot and possession of paraphernalia. Those are treated as petty offenses. Possession of more than one ounce is a state offense.

The changes were approved by the Basalt Town Council, 7-0.
