DENVER ” A California man has filed a federal lawsuit stemming from an alleged ski accident that occurred Dec. 28, 2007 on Aspen Mountain.

Howard D. Krepack sued Jay Friedstein this week in the U.S. District Court of Denver.

His suit claims he was the downhill skier when Friedstein collided with him. The Colorado Ski Safety Act stipulates that the downhill skier has the right of way.

The suit claims that Krepack suffered a broken right tibia and a “displaced fracture” of the right fibula, along with “irrevocable loss of enjoyment of life … pain suffering and emotional and mental distress.”

Filed by Glenwood Springs attorney Sander N. Karp, the suit seeks a jury trial.
