Aspen dog owner won’t have his day in court

ASPEN ” A Park Avenue resident whose dog was accused of attacking another pooch in August won’t be headed to court after all, an Aspen city official said Tuesday.

Assistant City Attorney Jim True said he dismissed the case against Dieter Bibbig, which was scheduled for trial Wednesday morning in Aspen Municipal Court. True said he made the decision after being informed the witness to the incident was out of the country.

The case was dismissed “without prejudice,” meaning True can re-file within one year, something he’s not sure will happen.

“We would like to see if we can work something out,” said True, who suggested that, should Bibbig be able to address certain security issues for his dog, then the case would likely not be re-filed.

The case stemmed from an Aug. 12 incident, in which Bibbig’s dog Henner, a German shepherd, was accused of running out from his 333 Park Ave. residence and attacking a leashed dog that was walking down the street with Graham Loving.

Loving is a friend of the animal’s owner, Pat Reutershan, according to a police report.

The incident prompted police to cite Bibbig on Aug. 14 for keeping a vicious dog and a dog running at large.
