Aspen burglary suspect sleeps in for court appearance

ASPEN – An Aspen man was a no-show for a court hearing after he slept in Wednesday morning, but a judge quashed a warrant for his arrest after he turned himself in later that afternoon.Timothy Joseph Tobin III, 30, who faces burglary charges related to an alleged break-in at an Aspen sporting-goods shop, was supposed to appear in court so that his attorney could argue for the release of his iPhone and computer, which police had seized following his arrest. The hearing was put off after he missed court. At an afternoon hearing, Judge Gail Nichols quashed a warrant for Tobin’s arrest after his attorney, Chip McCrory, said he meant to appear in court but simply slept in. He’s scheduled to return to court May 20.Police believe that Tobin stole numerous items from the D&E/Four Mountain Sports shop in Aspen. Among the items allegedly swiped were 11 Burton snowboards, 17 GoPro cameras, snowboard boots and other goods, according to a search warrant. Police recovered six of the snowboards and two of the cameras, among other items, from Tobin’s apartment, according to the search warrant. Police allege that Tobin stole nearly $19,000 worth of goods from the store.
