Arbitrator entering Miller ski film dispute
October 21, 2009
DENVER – Federal court records indicate an arbitrator is getting involved in a film company’s dispute over whether a rival company can also use the name of legendary ski filmmaker Warren Miller.
Warren Miller Entertainment Inc. was seeking a preliminary injunction to bar Denver-based Level 1 Productions Inc. from using Miller’s name, likeness or narration in its new movie “Refresh.” It contends Level 1 is infringing on its rights to the Warren Miller name.
A federal judge on Tuesday denied the request and stayed the matter until arbitration between Warren Miller Entertainment and Miller himself is complete.
Miller, who has his own company, argues that his non-compete clause with Warren Miller Entertainment expired in 1999.
