RFTA sued over pedestrian accident at Aspen crosswalk

An Aspen woman alleges that she was struck by a public bus while she was on the crosswalk at South Mill Street and East Durant Avenue.

Marilyn Carroll filed suit Wednesday against the Roaring Fork Transportation Authority and driver David Michael Drop in Pitkin County District Court.

Her suit says she was struck by the bus at approximately 6:30 a.m. Oct. 13, 2013.



Carroll was knocked to the ground and suffered numerous injuries, the suit says. She underwent a knee-replacement surgery and had injuries to her face, left leg and foot. She can no longer enjoy her decades-long pursuits of skiing and hiking and missed time from work because of the accident, the suit says.

RFTA attorney Paul Taddune said he could not comment about facts of the case. RFTA’s adjuster currently is reviewing Carroll’s medical information, he said.




The driver will be covered by RFTA because the accident happened during his scope of employment, Taddune said.

Both RFTA and Drop face negligence charges, and RFTA also is being sued for negligent hiring.

In Colorado, $350,000 is the maximum in damages an individual can collect in personal-injury cases against public entities or employees.
