ASPEN — A January trial date has been set in the city of Aspen’s case against a local resident who stands accused of illegally operating a free taxicab business since 2006, an official said Tuesday.

Cabbie Phil Sullivan faces multiple counts in connection with the case. The counts range from operating without a business license to failure to pay the city’s occupation tax, as well as operating a cab without a meter or rate card, according to court documents.

The city also contends Sullivan failed to file a business tax return, and has not complied with laws and regulations related to public health, safety, morals or welfare.

The counts cover a period from “some portion of calendar years 2006 and 2007 and during 2008,” documents show.

Aspen Assistant City Attorney Jim True said Tuesday the trial would take place Jan. 14 in municipal court.

Sullivan’s troubles stem from a complaint filed by High Mountain Taxi Service of Aspen in 2006 with the Colorado Public Utilities Commission (PUC). An administrative law judge later ruled Sullivan owed $12,100 in fines for violating PUC regulations.

Sullivan also was issued a summons by the city of Aspen in spring of this year, which led to his upcoming trial.
