ASPEN — A local dentist is butting heads with the Internal Revenue Service, apparently is refusing to comply with an audit.

Federal officials filed a federal court petition July 23 to enforce an IRS summons mandating that Dr. William Wesson of Aspen produce information for an audit.

Reached at his office, Wesson said he could not comment on the mat­ter yet.

In March, agents served the orig­inal summons, calling Wesson to testify and produce certain books, records, papers and data account­ing for his taxes dating back to 2003. Instead, Wesson demanded a cer­tified copy of an IRS agent’s oath and a copy of the agent’s photo ID, according to court documents.

Wesson threatened to file a crim­inal complaint if the agent did not produce the information. IRS agents then turned to the federal court system.

An IRS spokeswoman said agents perform audits both at random and based on an individual’s business and personal activity. If a taxpayer is asked to produce records for the audit, they are compelled to pro­duce the information.

Noncompliance is common, and so is court action, according to the IRS.
